Requirements Before Getting Married In NY

By Marla Mills

Almost every state has its rules on the marriage process. This is true about communities too. Before you can get married, the entire family wants to look out for you. With this in mind, there are regulations that govern the process of getting married in NY City. Every couple that looks forward to marriage must meet the set requirements before they can get the license to hold their ceremony.

The first thing to come to mind should be the eligibility. To perform the marriage ceremony, you need to have a license. This document can only be issued by the town or city clerk within the state of New York. At this point, it is advisable to find out whether you are eligible for the license before making any further steps.

Among the measures in place include the requirement of consents if any or both of the couple that intends to marry are 14 years of age. No licenses can be given for anyone under the age of 14. For the 14 year old couple, there has to be an order from the court and getting this order also demands for certain things. The court will have to screen the couple thoroughly.

If you have a couple that is 16 years or bellow, it is still considered that they are not of consenting age. Therefore the clerk will demand for a written consent by the parents. Without such written consents from both parents, the document will not be issued. These measures are put in place to make sure that anyone who is very young does not get married without involving their families.

The license also has a validity period. You cannot just get licensed and keep it for years waiting to get married when you feel like it. Instead, all applicants who get the approval of the town or city clerk have to make good their intention after 24 hours but within six months after the date of issue.

Just like many other state issued licenses, the marriage license has a validity period. You cannot expect the document to last forever. If you have the green light to marry, the marriage must take place within 6 months but not before the first 24 hours are passed. This is a call for anyone keen on marrying to make plans before hand so that the license does not expire.

The license has a validity period attached and there are other rules as well. An important rule is that the marriage cannot take place within the first 24 hours after the license has been issued. You need to wait for 24 hours before you can get married. This means you cannot get licensed by the clerk on the same day you intend to get married.

For anyone consenting when minors are getting married in NY, it is mandatory that you appear in person at the office of the city or town clerk. Only if a parent is deceased or judged incompetent can a guardian represent them. All these measures are supposed to ensure the couple does not compromise their safety while marrying.
